Luke McLean is the Principal Lawyer and founder of McLean Legal.

Luke practises exclusively in migration and refugee law and advises clients across Australia and overseas. He represents individuals and families in visa applications, merits review proceedings, judicial review applications, ministerial intervention requests and complex character matters.

His approach combines strategic legal advice, careful preparation and strong advocacy. Luke works closely with every client to understand their circumstances and develop solutions tailored to their individual situation.

Luke has extensive experience representing clients across all stages of the Australian migration system, including applications before the Department of Home Affairs, merits review applications before the Administrative Review Tribunal, and judicial review applications in the Federal Circuit and Family Court, Federal Court and High Court of Australia. He regularly advises in complex migration matters involving protection visas, character-related visa refusals and cancellations, ministerial intervention requests, national security concerns, and other sensitive cases where strategic advocacy is critical.

Luke is particularly experienced in character matters involving sections 36(1C), 116 and 501 of the Migration Act 1958, including Ministerial decisions that are not subject to merits review. He assists clients with submissions to the Department or Minister, merits review, judicial review, and pathways to overcome or respond to adverse decisions.

His experience also includes challenges relating to the lawfulness immigration detention and the representation of refugees detained offshore in Nauru and Manus Island, including securing urgent transfers to Australia for medical treatment.
